Terms of Service

These Terms of Service explain the terms that apply when you purchase, activate, or use the service provided by Don’t Call Me Inc., operating in English as Don’t Call Me and in French as StopAppel.

 

In these Terms, “we,” “us,” and “our” mean Don’t Call Me Inc. “You” and “your” mean the customer, purchaser, service user, or other person using, purchasing, activating, or arranging the service.

 

By purchasing, activating, or using the service, you agree to these Terms, the Privacy Policy, the authorization language, the consent language, and any checkout acknowledgments presented to you at the time of purchase or activation.

 

We use one national customer framework across Canada. All customers receive the same substantive customer-facing text in English and French. For customers in Quebec, the French version prevails if there is any inconsistency between the English and French versions. For customers in the other provinces and territories, the English version prevails if there is any inconsistency between the English and French versions.

 

1. What the service is

 

Don’t Call Me Inc. provides a paid administrative agent service for Canadian consumers who want help reducing unwanted telephone solicitation.

 

The service is limited to submitting do-not-call, consent-withdrawal, and suppression requests to selected organizations and companies on a customer’s behalf, and related administrative activities. These selected organizations and companies may include charities, foundations, businesses, and similar entities that may make, cause, support, or receive requests connected to telephone solicitation, fundraising, renewal, retention, upgrade, win-back, cross-sell, donor, customer, or similar outreach activity.

 

Where applicable as part of service administration, we may submit your telephone number to the National Do Not Call List registration process. The service may also include keeping records of requests submitted, using internal customer reference codes or other non-secret technical identifiers, receiving limited customer reports, updating our operational coverage, and communicating with selected organizations, companies, vendors, call centres, service providers, the Canadian Radio-television and Telecommunications Commission (CRTC), or another appropriate body where reasonably necessary.

 

2. What the service is not

 

Don’t Call Me Inc. is not a call blocker, government service, regulator, enforcement agency, law firm, paralegal service, legal representative, consumer protection agency, or complaint-handling service.

 

Don’t Call Me Inc. does not provide legal advice, legal representation, individualized legal guidance, call investigations, compensation claims, litigation threats, or one-off dispute handling.

 

Don’t Call Me Inc. does not block calls through the phone network, a mobile carrier, a device, an app, spam-labelling technology, or phone settings. We do not identify, trace, investigate, or stop spoofed, fraudulent, scam, phishing, impersonation, illegal robocall, or other unlawful calling activity.

 

3. Selected organizations and companies

 

The service applies to selected organizations and companies that we include in our operational coverage. We decide which organizations and companies are included, updated, removed, prioritized, or handled as part of the service.

 

We may include organizations and companies in our operational coverage where we reasonably believe they have made, caused, facilitated, supported, received, processed, enabled, or operationally supported telephone solicitation, fundraising, renewal, retention, donor, customer, sales, win-back, upgrade, cross-sell, or similar outreach to Canadian consumer telephone numbers, or where we reasonably believe they are planning, preparing, resuming, outsourcing, or likely to launch such activity within the next three years. This may occur because we provide broad operational coverage, because public mapping is imperfect, because related entities or vendors may be involved, or because a broader request may be more administratively useful.

 

You may tell us which organizations or companies are particularly bothersome to you. We may use that information to improve or update our operational list, but we do not guarantee that any specific organization or company will be added, contacted, prioritized, investigated, or handled individually.

 

4. Authorization to act as administrative agent

 

By purchasing, activating, or using the service, you authorize Don’t Call Me Inc., operating in English as Don’t Call Me and in French as StopAppel, to act as your limited administrative agent for the purpose of submitting do-not-call, consent-withdrawal, suppression, and related exclusion requests to selected organizations and companies on your behalf, including charities, foundations, businesses, and similar entities.

 

Where applicable as part of service administration, you authorize Don’t Call Me Inc. to submit your telephone number to the National Do Not Call List registration process. Don’t Call Me Inc. does not verify whether your telephone number is already registered on the National Do Not Call List.

 

You also authorize Don’t Call Me Inc., where it reasonably considers it appropriate, to disclose your relevant personal information to the Canadian Radio-television and Telecommunications Commission (CRTC) or another appropriate body in connection with possible non-compliance, repeated calling, refusal to process requests, failure to honour suppression requests, refusal to add your name and/or telephone number to a do-not-call list, refusal to acknowledge Don’t Call Me Inc.’s authorization to act as your limited administrative agent, or related operational issues.

 

This authorization permits Don’t Call Me Inc. to make those communications, but does not require it to make, pursue, escalate, or follow up on any complaint, report, referral, or other communication on your behalf.

 

5. Consent to collect, use, disclose, and retain personal information

 

By purchasing, activating, or using the service, you consent to Don’t Call Me Inc. collecting, using, disclosing, and retaining your personal information as reasonably necessary to provide and administer the service. This may include your name, telephone number, email address, postal code, payment confirmation information, service records, internal customer reference codes, verification identifiers, authorization tokens or other non-secret technical identifiers, request history, call-report information you choose to provide, and any other information you choose to provide.

 

You understand that Don’t Call Me Inc. may use this information to submit, support, track, and keep records of do-not-call, consent-withdrawal, and suppression requests on your behalf, and to complete National Do Not Call List registration where applicable as part of service administration. This may include disclosing your name, telephone number, and postal code to selected organizations and companies, including charities, foundations, businesses, and similar entities, and to their agents, vendors, call centres, fundraising agencies, telemarketing firms, or service providers where reasonably necessary for matching and processing.

 

You also understand that Don’t Call Me Inc. may use this information to help organizations and companies identify your name, telephone number, and postal code in their records and add your name and telephone number to their do-not-call, suppression, consent-withdrawal, or equivalent exclusion lists.

Your personal information is handled in accordance with our Privacy Policy.

 

6. Customer information and accuracy

 

You are responsible for providing accurate, current, and complete information. This includes your name, telephone number, email address, postal code, and any other information needed to provide the service.

We may be unable to provide the service, complete requests, match your information to an organization’s records, complete any supporting National Do Not Call List registration, or communicate with you if your information is inaccurate, incomplete, outdated, or not associated with the telephone number you want covered.

 

Don’t Call Me Inc. does not verify whether your telephone number is already registered on the National Do Not Call List. Where the intake flow indicates that registration is needed or appropriate, you authorize Don’t Call Me Inc. to submit your telephone number to the National Do Not Call List registration process as part of service administration.

 

If you provide inaccurate information about your telephone number or National Do Not Call List status, the service may not provide the practical coverage you expected. Some calls that might otherwise be reduced through National Do Not Call List registration may continue until the number is registered or the registration becomes effective.

You must not provide another person’s personal information unless you have that person’s consent or the legal authority to do so.

 

7. Customer reference codes and authorization identifiers

 

We may generate customer reference codes, verification identifiers, authorization tokens, or other non-secret technical identifiers to help administer the service, maintain records, authenticate or verify service-related requests, connect customer records with requests submitted on your behalf, and demonstrate that Don’t Call Me Inc. is acting under a customer authorization.

Customer reference codes, verification identifiers, authorization tokens, and other non-secret service identifiers are internal and customer-facing administrative tools. We do not disclose these identifiers to selected organizations or companies for matching. The information used for organization matching is limited to your name, telephone number, and postal code, unless you separately provide different information through a report or other process.

 

These identifiers are not passwords, payment card numbers, or secret account-access credentials.

 

8. Service term

 

The standard service term is three years from the date your service begins, unless a different term is expressly stated at the time of purchase.

 

Processing begins shortly after purchase or activation. It may take up to 21 days from purchase or activation for coverage to take effect because receiving organizations and companies may need time to update their records. Where National Do Not Call List registration is submitted as part of the service, it may take up to 31 days from registration for National Do Not Call List protection to become effective.

 

The three-year term is connected to the practical operation of do-not-call and suppression request frameworks, including the general expectation that internal do-not-call information may need to be retained by organizations for a period of time.

 

Ongoing service during the term is limited. Customers may report calls they believe the service should have helped address through the available website process, if offered. We do not provide telephone support, individualized complaint handling, call investigations, one-off dispute handling, or a general customer-service commitment as part of the standard service.

 

9. No automatic renewal

 

The service does not automatically renew.

 

At the end of the service term, your service access expires unless you affirmatively purchase or activate a new service term.

 

During the active service term, we may send limited service-relationship communications, including administrative notices about the expiry of your service, one post-activation follow-up message, and one pre-expiry message during the final three months of your service term. Where a message includes referral information or an option to purchase a new service term, it will include sender identification and a simple way to unsubscribe from future commercial messages.

 

10. Fees, payment, and taxes

 

You agree to pay the fees presented to you at checkout. Applicable taxes may be added where required.

 

Payments may be processed by third-party payment providers, including Wix Payments or other payment processors we use. We do not intend to store full payment card numbers ourselves.

 

Payment processors may have their own terms, privacy practices, fraud-prevention procedures, and transaction rules. We are not responsible for payment processor errors, payment-card issuer decisions, bank decisions, payment network issues, or payment methods that fail, are declined, are reversed, or are not authorized.

 

11. No refunds once processing begins

 

All purchases are final and non-refundable once you have authorized Don’t Call Me Inc. and processing has begun.

 

Processing begins shortly after purchase or activation. Processing includes creating your service record, generating customer reference codes or other technical identifiers, preparing requests, submitting requests, transmitting your information, updating operational records, or otherwise beginning administrative work connected to your service.

 

Processing beginning shortly after purchase or activation does not mean the service will be fully implemented immediately. The timing for receiving organizations and companies to process suppression, consent-withdrawal, or do-not-call requests, and the timing for National Do Not Call List registration to become effective where applicable, is addressed in the service-timing provisions of these Terms.

 

If you withdraw consent, cancel, change your mind, stop using the service, provide inaccurate information, lose access to your email or phone number, or no longer want the service after processing has begun, you are not entitled to a refund.

 

Except where required by applicable law, you are not entitled to a refund once processing has begun, including if the service is later suspended, limited, discontinued, wound down, or otherwise no longer available in whole or in part.

 

Nothing in these Terms limits any non-waivable consumer protection right that applies to you under applicable law.

 

12. Service limits and no guarantee

 

Don’t Call Me Inc. operates within Canada’s telecommunications and privacy framework. Don’t Call Me Inc. may submit the required information to selected organizations and companies, including their vendors, call centres, agents, or service providers where appropriate, but cannot control the ultimate actions or decisions of those organizations, companies, or their representatives. Don’t Call Me Inc. also cannot control scammers, spoofers, impersonators, fraudulent callers, illegal robocallers, or other unlawful third parties.

 

The service is designed to help reduce unwanted telephone solicitation. However, because Don’t Call Me Inc. does not control the ultimate actions, decisions, systems, vendors, or compliance practices of other organizations and companies, Don’t Call Me Inc. cannot guarantee that any specific organization or company will process, accept, recognize, or honour a request, and cannot guarantee that all calls, or any particular calls, will stop.

 

Calls may continue for reasons outside Don’t Call Me Inc.’s control, including lawful exemptions, processing delays, incomplete or inaccurate records, data-matching limits, third-party vendor or call-centre errors, spoofed numbers, scam calls, fraudulent calls, phishing calls, impersonation calls, illegal robocalls, survey calls, political calls, or an organization’s failure or refusal to properly process or honour a request.

 

Some parties may act unlawfully, fail to follow applicable rules, fail to update their records, fail to instruct their vendors, fail to recognize your information, or continue calling despite receiving the relevant request.

 

13. Out-of-scope activities and National Do Not Call List registration

 

Unless we expressly add them to the service, the service does not cover business-to-business calling requests, numbers used primarily for business purposes, political parties, candidates, campaigns, political surveys, political communications, survey-only calling where no do-not-call or suppression obligation applies, email marketing, SMS marketing, direct mail, door-to-door marketing, or other non-telephone marketing.

 

The service does not cover non-Canadian organizations unless we reasonably determine that they are calling or causing calls to people in Canada in connection with Canadian-facing commercial, fundraising, donor, customer, or similar activity.

 

Don’t Call Me Inc. does not verify whether your telephone number is already registered on the National Do Not Call List. Where the intake flow indicates that registration is needed or appropriate, Don’t Call Me Inc. may submit your telephone number to the National Do Not Call List registration process as part of the service.

 

Submitting your telephone number to the National Do Not Call List registration process does not guarantee that all calls will stop. National Do Not Call List registration may take up to 31 days from registration to become effective and does not prevent calls that are exempt, unlawful, spoofed, fraudulent, political, survey-related, or otherwise outside the scope of the National Do Not Call List framework.

 

14. Customer reports

 

We may allow customers to report calls they believe the service should have helped address. If you report a call, we may collect the organization or company name, caller number, date and time of the call, and any notes or details you choose to provide.

 

We may use customer reports to update our operational list, assess possible service issues, support records of prior requests, identify possible patterns of non-compliance, or decide whether further administrative action is appropriate.

 

Submitting a customer report does not create an obligation for Don’t Call Me Inc. to investigate the call, determine who made the call, trace the caller, contact the organization individually, make a complaint, pursue a complaint, provide compensation, or provide individualized dispute handling.

 

15. CRTC and other appropriate bodies

 

Don’t Call Me Inc. may, where it reasonably considers it appropriate, communicate with the Canadian Radio-television and Telecommunications Commission (CRTC) or another appropriate body about possible non-compliance, repeated calling, refusal to add names and/or telephone numbers to a do-not-call list, refusal to process suppression or consent-withdrawal requests, refusal to acknowledge Don’t Call Me Inc.’s authorization to act as a customer’s limited administrative agent, failure to honour suppression requests, or related operational issues.

 

Don’t Call Me Inc. is not required to make, pursue, escalate, or follow up on any complaint, report, referral, or other communication.

 

16. Customer communications

 

You consent to receive electronic communications from Don’t Call Me Inc. that are reasonably necessary or legally required to confirm, provide, administer, support, or complete your service. These may include receipts, confirmations, administrative notices, service updates, service implementation notices, security notices, legally required notices, changes to the service or terms, one post-activation service follow-up message, and one pre-expiry notice during the final three months of your service term. Where a message includes referral information or an option to purchase a new service term, it will include sender identification and a simple way to unsubscribe from future commercial messages. Unsubscribing from commercial or promotional messages does not stop required service, legal, security, or transaction messages.

 

You are responsible for keeping your email address and other contact information current. We are not responsible if you do not receive service communications because your contact information is inaccurate, outdated, blocked, filtered, inaccessible, or no longer used.

 

17. Consent withdrawal

 

You may withdraw consent where legally and operationally possible. If you withdraw consent needed for us to provide the service, we may no longer be able to continue providing the service, and your service may end. Withdrawal of consent does not entitle you to a refund once processing has begun.

Withdrawal of consent applies to Don’t Call Me Inc.’s future collection, use, disclosure, and retention of your personal information, subject to legal, regulatory, tax, accounting, security, chargeback, dispute, audit, operational, and recordkeeping requirements. It does not require Don’t Call Me Inc. to retrieve, delete, or withdraw information that has already been disclosed to organizations, companies, their agents or service providers, the National Do Not Call List operator, the CRTC, or another appropriate body before the withdrawal took effect.

 

18. Minors and purchases for others

 

The service may be used by individuals who are able to understand and provide the required personal information, consent, and authorization for their own Canadian consumer telephone number, and who use a payment method they are authorized to use.

 

If you are under the age of majority in your province or territory, you must have any parent, legal guardian, tutor, or other legally authorized consent or permission required for you to provide the information, authorization, and consent needed for the service.

 

If you are under the age of majority in your province or territory, you must use a payment method that you are authorized to use and understand that the service involves a paid purchase, disclosure of your personal information to selected organizations and companies, and no refund once processing has begun except where required by law.

 

A parent, legal guardian, tutor, or other authorized person may purchase or arrange the service for another person, including a minor, parent, family member, or other individual, where they have the authority or consent required to provide that person’s information and authorization.

 

Gift certificates, prepaid service codes, or similar purchase options may be made available separately. If a gift certificate or prepaid code is purchased, we do not need the recipient’s service information until the service is redeemed or activated. The person redeeming or activating the service must provide the required consent and authorization, or must have the legal authority to do so for the recipient.

 

We may decline, suspend, or stop processing a request if we reasonably believe that the purchaser, requester, or person activating the service does not have the authority needed to provide the personal information, consent, or authorization.

 

19. Misuse of the service

 

You must not misuse the service. Misuse includes providing false information, impersonating another person, submitting information without authority, using the service for business numbers where the service is not intended for that purpose, interfering with the website or systems, attempting unauthorized access, abusing forms, submitting fraudulent reports, or using the service for unlawful purposes.

 

We may decline, suspend, stop, or limit service if we reasonably believe the service has been misused, the information provided is inaccurate or unauthorized, the request is outside scope, the customer cannot be verified, the request creates legal or operational risk, or continuing the service would be inappropriate.

 

20. Availability, changes to the service, and business continuity

 

We may update, modify, suspend, limit, or discontinue parts of the service from time to time. We may change forms, workflows, organization lists, vendor arrangements, communication methods, support processes, pricing, and operational practices.

 

We intend to provide the service for the applicable service term, but we cannot guarantee that every feature, vendor arrangement, organization list, workflow, support process, website function, or operational method will remain unchanged for the full term. Service coverage, technical tools, organization coverage, vendors, or operating methods may change over time.

 

If Don’t Call Me Inc. suspends, limits, discontinues, winds down, becomes unable to operate, becomes insolvent, or otherwise ceases providing all or part of the service, your rights, if any, will be determined by these Terms and applicable law. Except where required by applicable law, you are not entitled to a refund once processing has begun.

 

We will use reasonable efforts to provide the service, but we do not guarantee uninterrupted website access, uninterrupted processing, or continuous availability of every feature.

 

21. Third-party services and links

 

The service may depend on third-party providers, including website hosting, payment processing, email, records management, customer communications, automation, contractors, freelancers, and operational support.

 

We may also provide links to third-party websites, including government, regulator, payment, or service-provider websites. We are not responsible for third-party websites, third-party services, third-party content, third-party outages, third-party privacy practices, or third-party decisions.

 

22. Intellectual property

 

The website, service design, text, branding, forms, workflows, records structure, operational lists, and related materials are owned by Don’t Call Me Inc. or used under permission, except where otherwise stated.

 

You may use the service for your own personal, non-commercial purposes. You may not copy, reproduce, resell, scrape, reverse engineer, misuse, or commercially exploit the service, website, forms, workflows, or materials without our written permission.

 

23. Limitation of liability

 

To the fullest extent permitted by applicable law, Don’t Call Me Inc. is not liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, loss of opportunity, loss of goodwill, loss of data, or loss caused by third parties.

 

Once we disclose personal information to an organization, company, regulator, National Do Not Call List operator, or other appropriate body as part of the service, that recipient is responsible for its own handling, safeguarding, use, retention, and compliance obligations in relation to the information it receives, except to the extent applicable law provides otherwise. Don’t Call Me Inc. is not responsible for a recipient organization’s independent systems, security practices, privacy practices, breach incidents, misuse, errors, omissions, or failure to comply with applicable law, except to the extent caused by Don’t Call Me Inc.’s own breach of these Terms or applicable law.

 

To the fullest extent permitted by applicable law, Don’t Call Me Inc.’s total liability for any claim connected to the service is limited to the amount you paid for the service giving rise to the claim.

 

Nothing in these Terms limits liability that cannot be limited under applicable law.

 

24. Indemnity

 

You agree to be responsible for losses, costs, claims, damages, or expenses that arise from your misuse of the service, your violation of these Terms, your provision of false or unauthorized information, your unauthorized submission of another person’s personal information, or your unlawful conduct.

 

25. Governing law

 

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, except to the extent that mandatory laws of your province or territory of residence apply and cannot be excluded.

 

Nothing in these Terms limits any non-waivable right or protection you may have under applicable consumer protection, privacy, language, or other laws.

 

26. Changes to these Terms

 

We may update these Terms from time to time. The updated version will be posted on our website with a revised effective date or last-updated date.

 

If we make material changes, we may provide additional notice where appropriate or required. Your continued use of the service after updated Terms are posted or provided means you accept the updated Terms, except where applicable law requires a different process.

 

For a purchase already made, the version of the Terms accepted at checkout or activation will generally apply to that service term, unless a change is required by law, relates to service administration, improves customer rights, addresses operational risk, or applies to features or services used after the change.

 

27. Privacy requests and contact

For formal privacy requests, including access, correction, withdrawal, or privacy complaints, please use the process described in our Privacy Policy.

For general service or administrative inquiries, please use the contact method provided on our website. General inquiries are not a substitute for formal privacy requests unless we provide another written process.

28. Entire agreement

​

These Terms, together with the Privacy Policy, authorization language, consent language, checkout acknowledgments, and any terms presented to you at checkout or activation,

form the agreement between you and Don’t Call Me Inc. for the service.

 

If any part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply.
